INSOLVENCY TRAINING FOR BRUNEI COURTS, AGC, LAW SOCIETY, BANKS AND FINANCIAL REGULATORS

1. The Brunei Judiciary and Singapore Judiciary collaborated together in organizing the ‘Insolvency Training Programme for the Brunei Courts, the Attorney General’s Chambers, The Law Society, Banks and Financial Regulators’ hosted and organized by INSOL International.

2.  The three-day training programme is held as a webinar and is a landmark event, being the first of its kind in Brunei Darussalam in bringing together key players in the domestic insolvency and restructuring landscape. The programme covered topics ranging from the Personal Insolvency experience in Singapore and Australia, Current Trends and Practice in Insolvency and Restructuring Law, and MSME Insolvency.

3. The speakers at the training programme featured a line up of eminent international speakers, including those from the Supreme Court of Singapore, the Insolvency and Public Trustee’s Office of Singapore (IPTO), the Australian Financial Security Authority (AFSA), INSOL International, Singapore Management University, the World Bank, the Ministry of Law of Singapore and DHC Capital.

4.  The programme commenced on Thursday 8 September 2022 with opening remarks made by The Honourable Chief Justice of the Supreme Court of Brunei Darussalam, Dato Seri Paduka Steven Chong. In his address, the Chief Justice expressed his gratitude to INSOL International and Justice Kannan Ramesh of the Singapore Judiciary for making the training programme possible and for their support and continued engagement with the Brunei Judiciary.

5.  The Chief Justice said that “Through this initiative, we hope to equip all stakeholders with more knowledge and expertise on insolvency and restructuring regimes as it involves a multitude of disciplines that combines legal, economic, technical and fiscal aspects. The training programme is timely with the increasing focus and concerted efforts of various local stakeholders from the private and public sectors to strengthen Brunei Darussalam’s insolvency and restructuring regimes.”

6. The Chief Justice encouraged institutions, practitioners, lawmakers, policymakers and the courts to work together to facilitate an effective restructuring and insolvency regime. He emphasized how it is “critical that all stakeholders recognise the importance of an effective insolvency and restructuring ecosystem in bringing benefits for our local economy in promoting entrepreneurship, access to finance and economic growth” particularly in the current economic climate in the context of recovery post COVID-19.

7. Participants of the training programme comprised of justices, judges and judicial officers from the Brunei Judiciary, officers from the Attorney General’s Chambers and Prime Minister’s Office, members of the Law Society, representatives from various government ministries and departments, banks, financial institutions and regulators.
