Q. What is the Small Claims Tribunal ? A. The Small Claims Tribunal (SCT) is a tribunal that hears private summons from claims under $10,000.00. Claims are limited to simple contract cases and simple tort cases.
Q. How do I know if my claim is suitable to be heard in the SCT? A. Please refer to our
checklist to determine whether your claim ought to be heard before the SCT
Q. Is the hearing process different from ordinary private summons? A. Yes. The aim of the SCT is to reach an amicable settlement suitable for both parties. A consultation will be held initially to assist parties to negotiate and talk to each other to try settle the matter. In the event parties are unable to settle the matter a simple hearing shall be held before the tribunal before an adjudicator who will rule on the matter.

Q. Where do I file my claim? A. Claims that are filed with the SCT may be filed with the Subordinate Court Registry, Law and Courts Building, Ground Floor, Jalan R.I.P.A.S. , Bandar Seri Begawan, Brunei Darussalam. Claims may be filed during counter opening on Monday - Thursday and Saturday, at 8.00am to 11.0am and 2.00pm to 3.15pm.

Q. How do I serve the claim and other documents? A. You may serve the other side personally, by registered post or seek assistance of the Court to serve the documents through the Court's process server. For the fees chargeable by the process server

A. No, lawyers may not appear for the consultations or hearings before the SCT.
Q. How will I know when to attend Court for the consultation/hearing? A. The Court will issue Notices to parties to attend Court.
Q. Where will the consultations/hearings be held? A. Both the consultations/Hearings will be held in the Subordinate Court on the ground floor of the Law and Courts Building.
Q. Will the consultation/hearing be held in English or Malay? A. Both the consultation and hearing will be held in English. However, interpreters shall be provided so that parties may communicate in the language of their choice.
Q. Do I still have the right to appeal if I may not satisfied with the decision before the SCT? A. Yes, you will have the right to appeal to the High Court against the SCT's decision after hearing. You may hire a lawyer to act on your behalf for appeal purposes.
